{"id":34430,"date":"2022-03-23T08:00:00","date_gmt":"2022-03-23T08:00:00","guid":{"rendered":"https:\/\/www.redpepper.org.uk\/?p=34430"},"modified":"2024-01-30T12:35:12","modified_gmt":"2024-01-30T12:35:12","slug":"trans-rights-gender-recognition-reform-ban-scotland-uk","status":"publish","type":"post","link":"https:\/\/www.redpepper.org.uk\/society\/lgbtqplus\/trans-rights-gender-recognition-reform-ban-scotland-uk\/","title":{"rendered":"The long road to gender recognition reform"},"content":{"rendered":"\n<p class=\"drop-cap-paragraph\">In 2015, according to <em>The Telegraph<\/em>, \u2018<a href=\"https:\/\/www.telegraph.co.uk\/women\/life\/why-2015-was-the-year-trans-finally-went-mainstream\/\">trans went mainstream<\/a>\u2019. Now, in 2023, transgender people in Britain find ourselves potentially without <a href=\"https:\/\/www.thepinknews.com\/2023\/02\/09\/tavistock-gender-clinic-closure-staff-open-letter-trans-healthcare\/\">healthcare for kids<\/a>, adult healthcare costs spiralling even further <a href=\"https:\/\/www.whatdotheyknow.com\/request\/gic_waiting_list_3#outgoing-1404742\">out of control<\/a>, recorded anti-trans&nbsp;<a href=\"https:\/\/novaramedia.com\/2023\/02\/20\/welcome-to-terf-island-how-anti-trans-hate-skyrocketed-156-in-four-years\/\">hate crimes<\/a>&nbsp;skyrocketing&nbsp;and Westminster risking constitutional crisis by&nbsp;blocking the Scottish Parliament&#8217;s <a href=\"https:\/\/www.thenational.scot\/news\/23252960.uk-government-blocks-scotlands-gender-recognition-reform-bill\/\">Gender Recognition Reform<\/a>&nbsp;(GRR) bill.<\/p>\n\n\n\n<p>How did we get here?&nbsp;As has been <a href=\"https:\/\/www.opendemocracy.net\/en\/5050\/british-media-your-bigotry-is-killing-trans-people\/\">said by many before<\/a>, a huge portion of responsibility for rising anti-trans moves lies at the national and popular media&#8217;s door, due to its campaign to whip up public opinion against trans individuals and the community at large. Consistently negative reporting has wide-ranging impact, from policy through to our interpersonal relationships.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.bbc.co.uk\/sport\/athletics\/61332123\">Fear-mongering articles<\/a> about trans women\u2019s inclusion in elite sports, for example, prompted the previous <a href=\"https:\/\/www.dailymail.co.uk\/sport\/sportsnews\/article-10963271\/Nadine-Dorries-insists-womens-sport-reserved-born-female.html\">Culture Secretary to argue<\/a> that women\u2019s sport \u2018must be reserved for people born of the female sex\u2019. <a href=\"https:\/\/www.theguardian.com\/sport\/2023\/feb\/03\/uk-athletics-trans-women-female-events-law-change\">Bans on trans athletes<\/a>\u00a0is however largely felt at the grassroots level, where trans young people are being <a href=\"https:\/\/www.thepinknews.com\/2022\/06\/23\/trans-sports-ban-uk-children\/\">told they can\u2019t take part<\/a> in sports days and are made to wear gendered uniform or play in gendered teams, which can exacerbate existing dysphoria. It\u2019s important to remember that all elite athletes are outliers, extreme representations of what humans can achieve. <\/p>\n\n\n\n<p>Regardless of what may be considered \u2018fair\u2019\u00a0at a competitive levels, the constant backlash against a select few trans individuals has had a huge ripple effect, tearing down trans people\u2019s confidence to simply participate in community sports.<\/p>\n\n\n\n<p>Popular media reports have also shaped&nbsp;the conversion on so-called conversion therapy. Despite the UK government <a href=\"https:\/\/www.gov.uk\/government\/consultations\/banning-conversion-therapy\/banning-conversion-therapy\">originally committing<\/a> to banning \u2018the&nbsp;coercive and abhorrent practice of conversion therapy\u2019 as recently as 2021, the process has been completely demoralising. First we faced plans to drop the commitment entirely, then a <a href=\"https:\/\/www.bbc.co.uk\/news\/uk-60947028\">U-turn last April<\/a> that would have excluded trans people from the ban that cited \u2018unintended consequences\u2019, then thankfully the recent announcement of a <a href=\"https:\/\/www.bbc.co.uk\/news\/uk-64304142\">fully inclusive<\/a> ban of the traumatising practice.<\/p>\n\n\n\n<p>The \u2018unintended consequences\u2019 narrative echoes and circles back to never-ending discussions on transition regret and disproportionate focus on those people who have detransitioned. Reports on detransition are frequently made in bad faith, with the press seemingly refusing to accept the overwhelming evidence that medical transition results in, by far, the best outcomes for trans individuals, with regret being vanishingly small: a <a href=\"https:\/\/epath.eu\/wp-content\/uploads\/2019\/04\/Boof-of-abstracts-EPATH2019.pdf\">recent study<\/a> of 3,400 NHS gender identity clinic patients found that only 16 (0.47%) regret their transition, with even fewer taking material steps to detransition.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Battle fatigue<\/h2>\n\n\n\n<p>Efforts to improve policies that impact trans people, particularly those concerning the NHS failures to support us, have led to recurrent public consultations that have led to little positive effect. Non-binary philosopher <a href=\"https:\/\/etheses.whiterose.ac.uk\/27561\/1\/Cull160202650EngineeringGenders.pdf\">Matthew Cull<\/a>&nbsp;suggests that this cycle can&nbsp;result in a phenomenon called \u2018consultation fatigue\u2019 \u2013 wearing out the trans population so much that we give up demands for adequate healthcare and legal protections.<\/p>\n\n\n\n<p>Cull frames the current political climate through a lens of gender hegemony, inspired by <a href=\"https:\/\/www.dukeupress.edu\/sexual-hegemony\">Christopher Chitty\u2019s<\/a> work on sexual hegemony, which examines centuries of\u00a0bourgeoise attempts to regulate homosexuality. <\/p>\n\n\n\n<p>Today&#8217;s obsessive consultations are also regulatory, and not launched with a genuine aim at establishing truth \u2013 trans people know the truth of what we are fighting for already.\u00a0Instead, they play a deeper political role, aimed at legitimating and reinforcing gender hegemony, establishing justification for anti-trans policy (or at least the continuation of current, deficient policy) by asking the same questions over and over until the normatively \u2018correct\u2019 answers are given.<\/p>\n\n\n\n<p>This is evident in Westminster\u2019s response to the Scots\u2019 defiance of hegemony.\u00a0Despite <a href=\"https:\/\/www.redpepper.org.uk\/trans-travesti-movement-rights-gender-identity-feminism-inclusive-argentina-abortion-lgbtq\/\" target=\"_blank\" rel=\"noopener\">other nations\u2019 successful implementation<\/a> of self-identification laws, Westminster wants to frame a positive\u00a0gender recognition certificate (GRC) reform as \u2018controversial\u2019, and perhaps more importantly, \u2018rushed\u2019. Characterising the bill as \u2018rushed\u2019 echoes narratives used to prevent healthcare options being given to trans youth. <\/p>\n\n\n\n<p>It also allows transphobic ministers a soapbox to air their \u2018concerns\u2019 about such policy, likely leading to yet another consultation, which in turn provides a formal platform for transphobic views to once again be publicised as legitimate moral concerns, rather than the obvious hatred and bigotry they represent. All this for a small piece of legislature!<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Small action, big impact<\/h2>\n\n\n\n<p>It\u2019s easy to feel cynical about these small steps, especially given how rapidly we see policy that negatively impacts trans people pushed through,<a href=\"https:\/\/www.hrw.org\/news\/2022\/11\/18\/us-state-readies-first-anti-transgender-bill-2023\"> particularly in the United States<\/a>. Such cynicism is not unfounded. There is little that a GRC does for a trans person in <a href=\"https:\/\/mermaidsuk.org.uk\/wp-content\/uploads\/2019\/12\/gender-recognition-guide.pdf\">their daily life.<\/a> That doesn\u2019t mean it\u2019s not important. <\/p>\n\n\n\n<p>The need to fight for reform has become even more apparent in light of the recent murder of trans teen <a href=\"https:\/\/www.theguardian.com\/uk-news\/2023\/mar\/15\/brianna-ghey-funeral-hundreds-pay-tribute-to-murdered-teenager\">Brianna Ghey<\/a>,\u00a0who at sixteen was not eligible to use the current GRC process. As a result, her death certificate will label her as \u2018male\u2019. The trans fear of what will happen after our deaths is longstanding \u2013 the only reason why we know that Victorian surgeon, <a href=\"https:\/\/www.oxfordstudent.com\/2021\/11\/23\/transgender-history-remembering-dr-james-barry\/\">Dr James Barry<\/a> was transgender, for example, was because his death wishes were disrespected, revealing to the world his assigned gender at birth.<\/p>\n\n\n\n<p>A GRC impacts upon three of the most significant aspects of people\u2019s lives: birth, marriage and death. That\u2019s why it matters, despite the effects of a GRC being invisible in day-to-day life. By making the process of obtaining at GRC (or to <a href=\"https:\/\/transsafety.network\/posts\/you-dont-need-a-grc-death-cert\/\">remove sex identifiers<\/a>&nbsp;from documents) as hard as possible, this government refuses trans people any sense of authenticity in those major live stages. I am a transgender man. I should not have to get married or die as a woman.<\/p>\n\n\n\n<p>In this context, our fight for dignity as trans people is two-fold: we have to fight legislative violence and physical violence. A GRC would not have protected Brianna from the hatred of the media, nor the poisonous rhetoric of the <a href=\"https:\/\/transsafety.network\/posts\/the-big-lie\/\">organised transphobic right<\/a>, which fuels the violence that caused her death. But she still deserves dignity.\u00a0<\/p>\n\n\n\n<p>In today&#8217;s Britain, other trans people will continue to die through fatal attacks, as Brianna, or indirectly from the failures of the NHS and related services.
