{"id":32710,"date":"2022-04-28T09:48:29","date_gmt":"2022-04-28T08:48:29","guid":{"rendered":"https:\/\/www.redpepper.org.uk\/?p=32710"},"modified":"2025-08-12T15:39:01","modified_gmt":"2025-08-12T14:39:01","slug":"where-is-the-labour-party-heading-on-immigration","status":"publish","type":"post","link":"https:\/\/www.redpepper.org.uk\/political-parties-and-ideologies\/labour-party\/where-is-the-labour-party-heading-on-immigration\/","title":{"rendered":"Where is the Labour Party&#8217;s immigration policy heading?"},"content":{"rendered":"\n<p class=\"drop-cap-paragraph\">Nearly a year after it was first introduced, the Nationality and Borders Bill\u2019s journey through parliament is at an end. Some back-and-forth between the Houses of Commons and Lords briefly suggested that perhaps there was room for manoeuvre in the parliamentary process, as the Lords stripped the bill from some of its worst paragraphs. But in the end, Conservative MPs dutifully added them back in, and the <a href=\"https:\/\/www.thenational.scot\/news\/20100847.unfeasible-cruel-borders-bill-set-become-law\/\">bill passed on 28 April 2022<\/a>, without concessions.<\/p>\n\n\n\n<p>Although Labour\u2019s front bench has opposed the bill, their arguments remained focused on technicalities \u2013 that its measures are unworkable or cost the taxpayer too much \u2013 failing to engage politically in a way that challenged the bill\u2019s cruel racism.<\/p>\n\n\n\n<p>The two cornerstones of Labour\u2019s electoral strategy are to present Keir Starmer as a more capable and competent leader than Boris Johnson, and to unite their voting coalition around a set of \u2018core values\u2019. Labour\u2019s attitude towards the Nationality and Borders Bill, and the foreshadowing of their future immigration policymaking reflect this approach.<\/p>\n\n\n\n<p>For example, Stephen Kinnock, the shadow immigration minister, <a href=\"https:\/\/hansard.parliament.uk\/commons\/2022-03-22\/debates\/FA4FBF36-5168-4B9B-8C7E-09D2AAC33C39\/NationalityAndBordersBill\">argued<\/a> in a debate on the Nationality and Borders Bill that what is needed is \u2018a properly resourced and competent processing system\u2019 that is \u2018fair, compassionate and orderly\u2019.<\/p>\n\n\n\n<p>This approach too was mirrored in <a href=\"https:\/\/hansard.parliament.uk\/Commons\/2022-04-19\/debates\/04A9FDC8-59F6-4CA9-BEBD-3B6F5850D707\/GlobalMigrationChallenge#contribution-49EA1677-1B1B-4D24-B01D-F51FD8992B71\">Yvette Cooper\u2019s response to Priti Patel<\/a> when the Home Secretary gave a statement on the government\u2019s deal to send asylum seekers to Rwanda. The Shadow Home Secretary attacked Patel over \u2018unworkable, unethical\u2019 proposals that are \u2018extortionate in their cost to the British taxpayer\u2019.<\/p>\n\n\n\n<p>Both responses are apolitical, and instead focus on \u2018competence\u2019 and \u2018costs\u2019, suggesting that Labour would not oppose it on principle, but rather come forward with measures that make the managing of migration more efficient than the Conservatives.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Starmerite rhetoric for the Labour Party&#8217;s immigration policy<\/h2>\n\n\n\n<p>What, then would the Labour Party&#8217;s immigration policy look like? Thom Brooks, an American law professor on Starmer\u2019s payroll as a strategic adviser, recently published a <a href=\"https:\/\/fabians.org.uk\/publication\/new-arrivals\/\">Fabian pamphlet<\/a> setting out a new plan for immigration for Labour. It distinctly lacks any substantial policy suggestions but is heavy on Starmerite rhetoric of \u2018social contracts\u2019, \u2018prosperity\u2019, \u2018security\u2019 and \u2018community\u2019. It does not mention measures that will be brought in by the Nationality and Borders Bill, such as the criminalisation of refugees who arrive via \u2018illegal means\u2019 in the UK.<\/p>\n\n\n\n<p>On safe and legal routes, he advocates for a prioritisation of women and children and emergency schemes for conflicts, rather than universal support for all refugees. In best technocrat manner, the document proposes \u2018consultations\u2019 and \u2018reviews\u2019 that would allow Labour to avoid any firm commitments. Despite Brooks proclamation in his introduction that, as an immigrant himself, it is important to him to give a voice to the community, his proposals remain firmly within the framing of immigration and asylum as a \u2018challenge\u2019 to be \u2018tackled\u2019 and does not speak from the perspective of migrant communities or their needs.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Conditional rights<\/h2>\n\n\n\n<p>Starmer\u2019s \u2018social contract\u2019 is not one of equals entering into an agreement, as those in the liberal political tradition would want us to believe. Rather it is a set of obligations for immigrant communities who, if they do not comply, are not awarded basic rights.<\/p>\n\n\n\n<p>These obligations, often framed as \u2018integration\u2019 for \u2018social cohesion\u2019, will be informed by the \u2018shared values\u2019 framework developed by LOTO advisers such as Claire Ainsley and Deborah Mattinson. Ainsley has previously identified \u2018family, fairness, hard work and decency\u2019 as core values held by those that Labour could unite in its coalition.<\/p>\n\n\n\n<p>In Brook\u2019s pamphlet, an example of this approach is for example the automatic refusal of permanent residency or citizenship for those convicted of a hate crime or sexual offence. This supposedly reflects the values of \u2018fairness\u2019 and \u2018decency\u2019. Other suggestions are around language requirements, the creation of a new Life in the UK test and a new \u2018UK Day\u2019 bank holiday.<\/p>\n\n\n\n<p class=\"has-text-align-center rp-full-width rp-quote has-grey-color has-pale-1-background-color has-text-color has-background has-antonio-font-family\" style=\"padding-top:2%;padding-right:2%;padding-bottom:2%;padding-left:2%;font-size:clamp(1.743rem, 1.743rem + ((1vw - 0.2rem) * 1.571), 3rem);\">\u2018Integration\u2019 and \u2018civic identity\u2019 policy as a tool of population control could grow in importance.<\/p>\n\n\n\n<p>Needing to demonstrate \u2018shared values\u2019 as a marker of \u2018integration\u2019 to access a secure immigration status gives the state power to mould a person\u2019s behaviours and lifestyle choices. Such behavioural incentives would be framed as \u2018for the common good\u2019 of the national community, however who belongs to this community, and who benefits from this, is politically contested terrain.<\/p>\n\n\n\n<p>\u2018Integration\u2019 and \u2018civic identity\u2019 policy as a tool of population control could grow in importance. The influential think tank Policy Exchange published a report on the topic in March, which was co-authored by the widower of the late Labour MP Jo Cox, Brendan Cox, and interviewed a range of stakeholders, including Yvette Cooper. The report discusses policy ideas to encourage \u2018mixing\u2019 of communities to avoid \u2018parallel societies\u2019 to emerge.<\/p>\n\n\n\n<p>That a prominent Labour Party figure such as Cox, with good links to the upper echelons of the Labour Party and plenty of opportunity to lobby on policy is involved in a project like this (notably alongside Eric Kauffman, <a href=\"https:\/\/litilley.medium.com\/on-resigning-from-birkbeck-politics-3681c0f65a91\">controversial politics professor at Birkbeck College, University of London<\/a>) indicates where the wind on Labour\u2019s \u2018thought leadership\u2019 is blowing.<\/p>\n\n\n\n<p>All this indicates that, as preparations for the next elections are ramping up. Nothing looks set to change with labour party&#8217;s immigration policy, Labour continues its beaten path: immigrant communities are seen as a group that need to be controlled and managed, for the greater good of a society from which they are essentially excluded. Their needs and desires are not acknowledged by policymakers, and neither are they taken seriously as a constituency of voters in society.
